Rental Terms & Agreement

Welcome to Golf Sim OnDemand ("we," "us," or "our"). By renting launch monitors, pop-up hitting nets, mat simulator packages, or any related equipment ("Equipment") from us, you ("Renter," "you," or "your") agree to be bound by these Rental Terms and Agreement ("Terms"). These Terms govern your rental and use of the Equipment. If you do not agree, please do not proceed with the rental.
Please review these Terms carefully, as they contain critical information regarding your rights, obligations, and limitations of liability. We reserve the right to update these Terms at any time, with changes taking effect upon posting on our website. Your continued use of our services signifies acceptance of any revised Terms.
1. Rental Agreement
Equipment Rental: We offer Equipment for short-term rental (minimum 3 days per period), subject to availability and our approval. You are required to provide accurate information during the request process, including contact details, delivery address, and payment information.
Rental Period: The rental period begins on the delivery date and concludes on the agreed return date. Extension requests must be submitted at least 48 hours prior to the end date, subject to availability and additional fees. Late returns will incur an additional daily fee equivalent to the standard rental rate for the rented unit until return shipping confirmation is received by Golf Sim OnDemand.
2. Payment and Fees
Rental Fees: Fees are determined based on the Equipment type, rental duration, and any add-ons, with pricing provided in a custom quote upon request.
Payments: Payment for your rental is due prior to shipment and must be completed 72 hours before your reservation start date.
Payment Methods: We accept credit cards, PayPal, or bank transfers. Full payment is required at booking confirmation, with late payments subject to a 1.5% monthly interest charge.
3. Delivery and Return
Delivery: Equipment is shipped free to your specified address, arriving within 3-5 business days and no later than the day prior to your reservation’s start date. You must ensure a secure delivery location and be available for signature if required.
Inspection: Upon delivery, please inspect the Equipment and report any issues within 24 hours. Failure to do so waives claims of pre-existing damage.
Return: Ship your rental back on the last day of your reservation using the provided prepaid shipping label. Package it securely in the original or provided case. Late returns or improper packaging may result in additional fees.
Shipping Risks: We are not liable for delays caused by carriers or force majeure events (e.g., weather, strikes). In the event of delays, we will strive to ensure you receive your complete rental period.
4. Use and Maintenance
Permitted Use: Equipment is intended for personal, non-commercial golf practice only (e.g., home, range). Modifications or sub-renting are prohibited without our written consent.
Maintenance: You must use the Equipment responsibly, adhering to provided instructions. Repairs or alterations are not permitted. Report issues immediately; continued use waives damage claims.
Restrictions: Equipment must be used in appropriate environments (indoor/outdoor as specified). Avoid extreme weather, water, or misuse that could cause damage.
Software and iPad: The iPad and software are for rental use only. Unauthorized app downloads or setting changes are prohibited. Data erasure upon return is our responsibility.
5. Liability and Insurance
Renter Liability: You are responsible for loss, theft, or damage during the rental period. We recommend renter’s insurance; our liability is limited to the Equipment’s replacement value.
Indemnification: You agree to indemnify us against claims arising from your use, including injury or property damage.
Disclaimer: Equipment is provided "as is." We disclaim all warranties, express or implied, including fitness for a particular purpose. We are not liable for indirect damages (e.g., lost profits).
Force Majeure: We are not liable for delays or failures due to events beyond our control (e.g., natural disasters).
6. Cancellation and Refunds
Cancellation Policy: Cancellations made 72+ hours before delivery are fully refundable without fees. Within 48 hours, an 80% refund applies. No refunds are issued after delivery.
Refunds: Refunds are processed within 7 business days to the original payment method.
7. Governing Law and Dispute Resolution
Law: These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of laws principles.
Disputes: Any disputes will be resolved through binding arbitration in La Crosse, or small claims court if applicable. You waive the right to pursue class action claims.
Severability: If any provision is deemed invalid, the remaining terms remain enforceable.
8. Miscellaneous
Entire Agreement: These Terms constitute the full agreement, superseding prior discussions.
Electronic Signature: Digital acceptance at checkout is legally binding.
